These Terms and Conditions (“Terms”) govern your access to and use of the website www.petfairs.com and any related mobile applications, subdomains, or services provided by Petfairs (“Petfairs”, “we”, “us”, or “our”). By accessing, using, creating an account on, or purchasing products from the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
For purposes of these Terms:
“Buyer” or “you” means any person or entity who visits the Site, registers an account, or places an order.
“Seller” means any third-party supplier, manufacturer, or distributor listing products via the Site (if applicable).
“Products” means goods, merchandise, materials, or services made available on the Site.
“Order” means your request to purchase Products through the Site.
“MOA/MOQ” refers to minimum order amount / minimum order quantity as published on product pages or checkout.
These Terms apply to all visitors, users, and others who access the Site. The Terms form a legally binding agreement between you and Petfairs. We may modify these Terms from time to time; modifications are effective upon posting. Your continued use after posting constitutes acceptance of the updated Terms. Material changes will be highlighted where feasible.
You must be at least 18 years old or the age of majority in your jurisdiction to use this Site.
If you register on behalf of a business, you represent and warrant you have authority to bind that business and that the business meets our eligibility criteria.
Petfairs may establish separate account types (e.g., retail, wholesale, distributor) with particular qualification criteria and documentation requirements. Petfairs reserves the right to verify credentials and to accept, refuse, or reclassify account registrations.
To access certain features you must register and maintain an account. You agree to (a) provide accurate, current and complete information; (b) update account information promptly to keep it accurate; and (c) maintain the confidentiality of your password and access credentials.
You are responsible for all activity that occurs under your account, whether or not you authorized such activity. Notify us immediately of any unauthorized use or suspected breach. Petfairs is not liable for losses arising from unauthorized access unless caused by Petfairs’ gross negligence or willful misconduct.
Petfairs may suspend or terminate accounts for violations of these Terms or for suspected fraudulent or abusive behavior.
We strive for accuracy but do not warrant that product descriptions, images, specifications, sizes, weights, or other content are complete, current, or error-free. Colors may vary due to monitor differences. Petfairs may correct pricing or product information errors at any time. (See Pricing section.)
Product availability is subject to stock and supplier changes. Particular items may be discontinued or subject to limited runs. Petfairs may limit quantities on any order.
For multipack / mixed-pack / assortments we will include packaging/box-count details on product pages; however, actual count or mix may vary and we reserve the right to ship standard pack types.
Placing an order authorizes Petfairs to charge the payment method chosen at checkout. Orders are an offer to purchase subject to acceptance by Petfairs. We may accept or decline orders for any reason (e.g., stock unavailability, incorrect pricing, suspected fraud). Order confirmation e-mails acknowledge receipt but do not constitute acceptance. Acceptance occurs when we ship the Product(s).
Petfairs reserves the right to cancel or refuse service, terminate accounts, or cancel orders for any reason, including but not limited to: (a) inaccuracies in product or pricing information; (b) suspected fraudulent order; (c) inability to obtain authorization; (d) failure to meet MOA/MOQ; or (e) regulatory restrictions.
If we cancel an accepted order after payment, we will refund any amount already paid for the cancelled item(s) promptly. Shipping and handling charges are non-refundable unless otherwise stated.
All prices are shown in U.S. Dollars (USD) unless explicitly stated otherwise. Prices exclude taxes, duties, customs fees, and other governmental charges unless indicated. You are responsible for import duties and taxes applicable to your order.
We may run promotions or coupon codes with specific eligibility rules and expiry dates. Petfairs reserves the right to void promotions applied in error or in bad faith.
Petfairs accepts payment through methods displayed at checkout (e.g., major credit/debit cards, PayPal, wire transfers). Payment processing is subject to third-party processors’ terms and may include additional verification.
In the event of a pricing error (e.g., typographical error), Petfairs reserves the right to either honor the incorrectly priced order or cancel it and notify you; we retain discretion to choose which remedy to apply. (Industry practice and templates noted.)
Shipping methods, costs, and estimated delivery times are presented at checkout. All delivery times are estimates only. Petfairs shall not be liable for delays in delivery due to carriers, customs, adverse weather, force majeure events, or other causes beyond our control.
Title and risk of loss transfer to you upon delivery to the carrier, unless otherwise agreed in writing. For shipments originating from our U.S. warehouse, title typically transfers at point of carrier pickup. For international shipments, Incoterms shown on the invoice govern responsibilities (e.g., DDP, FOB, EXW).
If items fail to be delivered due to inaccurate shipping information provided by you, additional charges for re-shipment and any return shipping costs may apply.
Inspect shipments upon receipt. For visible damage, note the damage on the carrier’s paperwork and retain packaging. For concealed damage or missing items, notify Petfairs within 7 days of delivery with your order number and clear photos so we can begin a claim with the carrier. Failure to so notify may limit our ability to process claims.
For wrong or defective items, follow the Returns & Refunds procedure below. Petfairs may require evidence (photos, videos) and may coordinate with manufacturers or suppliers for warranty claims.
Return Eligibility:
Unless otherwise specified on the product page, items may be returned within 7 days of receipt, provided they are unused, in their original packaging, and accompanied by proof of purchase. Certain items — including clearance items, customized products, and hygiene-sensitive goods — are non-returnable.
Limited warranties: Unless a specific manufacturer warranty is provided, Petfairs disclaims all express and implied warranties to the fullest extent permitted by law. To the extent a warranty is provided, it is limited to the warranty terms expressly stated on the product page or accompanying documentation.
Third-party warranties: For products sold by third-party sellers on the marketplace, warranty claims typically need to be pursued with the seller or manufacturer; Petfairs will assist in coordination but is not automatically the warrantor unless explicitly stated.
Consumer Product Safety & Recalls: In the event of a product recall, Petfairs will cooperate with applicable authorities and notify affected customers to the extent contact information is available.
Limitation of liability: To the fullest extent permitted by law, Petfairs, its officers, affiliates, employees, agents, and service providers shall not be liable for any indirect, incidental, special, punitive, exemplary or consequential damages, lost profits, loss of business, or loss of data arising from or in connection with these Terms, the Site, or product use, even if advised of the possibility of such damages. Petfairs’ aggregate liability for direct damages arising from a single order shall not exceed the total amount paid by you for the product(s) in question, except where prohibited by applicable law.
Indemnity: You agree to indemnify, defend, and hold harmless Petfairs from any claim, demand, loss, damages, liability, costs and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your violation of applicable law; or (c) your negligence or willful misconduct.
All trademarks, service marks, logos, and content on the Site are the property of Petfairs or their respective owners and are protected by copyright, trademark, and other laws. Except as provided in these Terms, you may not reproduce, modify, publish, transmit, distribute, perform, display, or otherwise use any content from the Site without our express prior written consent.
You agree not to:
Use the Site for unlawful purposes or to solicit others to perform unlawful acts;
Interfere with or circumvent any security feature of the Site;
Attempt to gain unauthorized access to other accounts, computer systems, or networks;
Use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission;
Upload or transmit viruses, malware, or other harmful code;
Post, upload, or transmit content that infringes on the intellectual property rights of others.
Violation of these rules can result in account suspension, termination, and/or legal action.
If the Site includes marketplace features allowing third-party sellers to list products, Petfairs acts solely as a platform provider and does not itself sell such products unless explicitly stated. Petfairs is not responsible for the accuracy, safety, legality, or quality of marketplace listings or for transactions between buyers and sellers beyond facilitating payment and logistics where agreed.
Any disputes with third-party sellers should first be directed to the seller; Petfairs may mediate or take action (e.g., remove listings) when necessary. Petfairs reserves the right to require sellers to comply with our seller policies, including quality, labeling, and safety requirements.
Promotions, discount codes, rebates, or affiliate program terms are governed by program rules published at the time of promotion. Petfairs may modify or terminate promotions at any time. Abuse of promotional programs may result in denial of benefits and/or account termination.
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated by reference and available on the Site. By using the Site you consent to communications (e.g., order confirmations, service updates) via electronic means and to receive marketing communications where you have opted in; you may opt out of certain communications as provided in the Privacy Policy.
Petfairs may retain transaction records, communications, and purchase history in accordance with internal record-retention policies and applicable law. You are responsible for maintaining copies of important documentation; Petfairs may provide copies on request where feasible.
Petfairs will not be liable for any failure or delay in performing obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, pandemics, strikes, labor disputes, shortages of supplies, transportation disruptions, terrorism, governmental actions, cyber-attacks, or power failures.
Choice of law: These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles, unless otherwise required by applicable mandatory law.
Arbitration agreement & class waiver: Except where prohibited by applicable law, you and Petfairs agree that any dispute, claim or controversy arising out of or relating to these Terms, your use of the Site, or purchases (including interpretation, breach, termination, or validity) will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or Commercial Rules where applicable). The arbitration will be conducted in English in [San Francisco, California] (or another agreed-upon county in California). You and Petfairs both waive the right to a jury trial and to participate in a class or representative action. Sample arbitration clause language and drafting guidance are available from AAA and other sources.
Exceptions to arbitration: Certain disputes (e.g., intellectual property infringement claims, injunctive relief) may be brought in state or federal court. If a court finds the arbitration agreement unenforceable in whole or part, the remainder will survive to the extent permitted by law.
Petfairs may provide notices by posting on the Site, sending an email to your registered address, or through other contact information you provide. Legal notices to Petfairs should be sent to the contact information in Section 24.
If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
Failure by Petfairs to enforce any right or provision under these Terms will not constitute a waiver of such right.
You may not assign or transfer these Terms or your rights hereunder without Petfairs’ prior written consent. Petfairs may assign or delegate these Terms, in whole or in part, to any affiliate or successor.
These Terms, together with any order confirmation, invoice, and our Privacy Policy, constitute the entire agreement between you and Petfairs regarding the Site and supersede any prior or contemporaneous agreements, communications, or proposals.
